Participation is open to legal residents of the 50 United States and Washington, D.C. who are enrolled as students in grades kindergarten through 8 in any public or private school (excluding home school) as of September 1, 2008. See Rule 8, below, for further eligibility requirements/restrictions. Participation in this Contest requires prior parental approval. Void outside the 50 United States and D.C. and where prohibited by applicable federal, state, or local laws, rules or regulations. Contest begins September 2, 2008 at 9:00 am ET and ends on November 7, 2008 at 11:59:59 pm ET. DO NOT ENTER THIS CONTEST IF YOU DO NOT MEET ALL ELIGIBILITY REQUIREMENTS.
- How To Enter: The "Sara Lee Soft & Smooth Lunchtime is Showtime Video Contest presented by Sara Lee" (the "Contest") begins at 9:00 a.m. Eastern Time ("ET") on September 2, 2008 and ends at 11:59:59 p.m. ET on November 7, 2008 (the "Contest Period"). To enter, go to WWW. THEJOYOFEATING.COM (the "Web Site") and click on the Contest link to access the online entry form. To enter, a participant ("Participant") must:
- Complete the registration form by providing the information required; AND
- Upload a video that meets all of the Video Submission Requirements (as set forth below) and Contest Restrictions (as set forth below); each such video shall be referred to as the "Video Submission"; AND
- Enter a parent's or legal guardian's email address when registering. Parent or legal guardian will receive an email from the Sponsor, informing the parent/guardian of your Video Submission and your desire to participate in this Contest and giving the parent or legal guardian the opportunity to view your Video Submission and approve your participation in the Contest and agree to be bound by the Official Rules. If your parent/legal guardian does not notify the Sponsor of his/her approval of your Video Submission and participation in the Contest, and/or does not agree to be bound by the Official Rules, then your Video Submission will be disqualified and you will not be entered in the Contest.
Upon satisfactory completion of the above and upon receipt of approval by your parent or legal guardian, you will be entered in the Contest and your Video Submission and the information you submitted to enter will be referred to collectively as your "Entry". Within 72 hours of receipt of approval by a Participant's parent or legal guardian, Sponsor will use reasonable efforts to make Entries approved by the Sponsor which meet the terms and conditions of these Official Rules available for viewing online at WWW.THEJOYOFEATING.COM for the remaining duration of the Contest Period. Sponsor reserves the right to review and void any Entry it feels in its sole discretion does not comply with these Official Rules or that would be considered to be offensive to the viewing public or damaging to the Sara Lee or Disney brands. Sponsor may so void any Entry either before or after it is posted on the Web site. Limit one (1) Entry per person, household, and/or e-mail address per day. There may be only one (1) named Participant for each Entry submitted. Multiple submissions of the same Entry by the same Participant or by members of the Participant's household or by anyone other than the original Participant, will be disqualified. All entries must be submitted online in accordance with these Rules; No other method of entry will be permitted.
Contest ends and Video Submissions must be received and approved by parent or legal guardian by 11:59:59 p.m. ET on November 7, 2008. The computer clock of the Administrator is the official time keeping device of the Contest.
- Video Submission Requirements: Video Submission must demonstrate and/or explain how whole grains can fuel lunchtime fun. Video Submissions must be the original work of the Participant. The Participant must appear in the Video Submission. The Video Submission must feature/include a representation or image of Sara Lee Soft & Smooth branding, logos or packaging within the Video Submission. Participants are not required to purchase any Sara Lee products to fulfill this requirement. You may draw/paint your own copy of Sara Lee branding, logos or packaging to use in the Video Submission. The inclusion of Sara Lee Soft & Smooth branding, logos or packaging in a Video Submission will not, alone, influence the judging described herein. Sara Lee Limited License: You may use the Sara Lee name and logo for purposes of this Contest only.
No Infringement: Participants are prohibited from including any music from Disney's High School Musical 3: Senior Year and/or any music from Disney's High School Musical or Disney's High School Musical 2 in their Video Submissions. The content of the Video Submission must not infringe third party rights by including, for example, the copyrights, trademarks or logos (such as company names, labels or symbols other than those of Sara Lee) music, photographs, works of art, or images that have been created, distributed, aired or published by others, such as those on or in websites, television, movies, or other media outlets. No names, photos and/or likenesses of any person other than Participant may be included in the Video Submission without first obtaining permission from such person, and the Submission may not refer to public figures, contain materials embodying the names, likenesses, photographs or contain other identifying elements of any person, living, or dead, without appropriate prior permission.
A VIDEO SUBMISSION CONTAINING MUSIC OR LYRICS SHOULD ONLY CONTAIN ORIGINAL MUSIC CREATED BY THE PARTICIPANT. Do not use copyrighted music unless you own the copyright. If a song comes from a movie (such as "Over the Rainbow" from "The Wizard of Oz") or a stage musical (such as "Tomorrow" from "Annie"), or if it was a popular recording introduced in the 20th century (such as "You are My Sunshine") it is almost certainly still under copyright and your Video Submission will be disqualified.
Participants are solely responsible for Internet connectivity, software and/or hardware that may be required in order to create and/or submit any Video Submission. Video Submission is subject to and must meet and abide by all Official Rules as well as the following requirements or it will be disqualified.
Participants must upload their Video Submission as directed online at WWW. THEJOYOFEATING.COM, as set forth in these Official Rules and in accordance with the following requirements (collectively, the "Video Submission Requirements"):
- Video Submission must be in one of the following formats: .avi, .dv, .flv, .gif, .mov, .mp4, .m4a, .3gp, .3g2, .mpeg, .wav, or .rm.
- Video Submission may not exceed a file size larger then 10MB, or ninety (90) seconds in length;
- Video Submission must be in the English language;
- Video Submission must be the Participant's original creation, unpublished, the sole property of Participant, and not previously submitted in any other contest. Modifying, enhancing or altering a third party's preexisting work does not qualify as a Participant's original creation.
- Video Submission must include the Participant as the lead performer;
- The Sara Lee Soft & Smooth brand must be incorporated into Video Submission visually either with actual packaging and/or brand logo, or an image or representation you create of the packaging and/or brand logo; Participants are not required to purchase any Sara Lee products to fulfill this requirement.
- Secure Authorizations from all identifiable person(s) in Video Submission. Following Sponsor's receipt of Video Submission, Participant's parent or legal guardian will receive an e-mail asking for permission for Participant to participate (as noted previously). The e-mail will also contain a release that must be signed by parent/legal guardian of Participant and by any identifiable person (or such person's parent/legal guardian if a minor) that appears in, is heard in, or otherwise contributed to the Video Submission (a "Third Party Participant") confirming their consent for Participant to include such person in the Video Submission and allowing Sponsor to use their likenesses, names, voices or contributions for publicity including posting of the Video Submission on the website. Participant's parent or legal guardian, by entering and responding to e-mail request, represents and warrants that they have obtained written permission and all other necessary authorizations from any Third Party Participant allowing use of such person's name, likeness/voice or contribution in the Video Submission, and each Participant and Third Party Participant (or such Third Party Participant's parent/legal guardian if Third Party Participant is a minor) agree to and do hereby assign all rights for usage to Sponsor. Parent or legal guardian of any Participant may be required, at any time, to provide Sponsor with evidence of all such releases, assignments, written permission(s) and authorization(s). Third Party Participants must be of legal age of majority in the jurisdiction where they reside, unless a release has been executed by the parent or guardian of such Third Party Participant. The parent/guardian of the Participant who submitted the potential Winning Entry as defined below, will be required to provide evidence of all releases, assignments, written permission(s) and authorization(s) obtained from Third Party Participants (or from the parent/legal guardian of Third Party Participants if any such party is a minor), immediately upon request by Sponsor, or prize may be forfeited and, at Sponsor's sole discretion, awarded to the next highest scoring Video Submission based on the judging criteria stated herein. In the event that any individual appears with any Participant in a Video Submission, but such individual (or his/her parent/legal guardian if the individual is a minor) does not submit a separate Third Party Participant release in accordance with these Rules, the Sponsor may reject the Video Submission and disqualify the person who submitted it. If in its sole discretion Sponsor elects to accept any Video Submission, Participant's parent/legal guardian hereby represents and warrants (i) that they agree to assign any rights they or the Participant may have in the Video Submission to Sponsor, and forever releases and holds Sponsor harmless from and against any liability of any kind arising from or in connection with the use of the Video Submission, and (ii) that they, for themselves and for the Participant, agree to these Official Rules.
- Sponsor and/or its designees reserve the right not to post or accept any Video Submission in its/their sole discretion;
- By giving permission to submit a Video Submission, Participant's parent or legal guardian agrees that Participant's submission is gratuitous, unsolicited and without restriction, and will not place Sponsor under any obligation, and that Sponsor is free to disclose the ideas contained therein on a non-confidential basis to anyone or otherwise use the ideas without any additional compensation to Participant. Participant's parent or legal guardian acknowledges that, by acceptance of Participant's Video Submission, Sponsor does not waive any rights to use similar or related ideas previously known to Sponsor, or developed by its employees, or obtained from sources other than Participant. Any waiver of any obligation hereunder by Sponsor does not constitute a general waiver of any obligation to Participants. By submitting a Video Submission, Participant's parent or legal guardian acknowledges that Sponsor has no obligation other than those contained in these Official Rules to use or post such Video Submission.
By permitting his/her child to enter the Contest, each Participant's parent/legal guardian hereby warrants and represent that the Participant has not included any restricted content (see list of Content Restrictions below) in any Video Submission and has not violated any of the Video Submission requirements (see list of such Requirements above) with respect to any such Video Submission.
Content Restrictions: Content Restrictions include but are not limited to the following:
- content providing personally identifiable information about Participant or Third Party Participants, such as last name, address, phone number or any contact information;
- content in violation of third party rights including, but not limited to: copyrights, including copyrighted music, trademark, right of publicity or any other proprietary rights;
- content portraying libelous, defamatory, disparaging, tortuous or slanderous materials;
- any music from Disney's High School Musical 3: Senior Year and/or any music from Disney's High School Musical or Disney's High School Musical 2;
- content portraying pornography, adult-oriented content or any other sexually-explicit material;
- content portraying lotteries or gambling;
- content portraying explicit or offensive language or content;
- content portraying violence;
- content portraying imitations of people or characters from movie/shows, etc.;
- content portraying discrimination;
- content portraying promotion of illegal activities;
- content portraying tobacco, alcohol or drugs;
- content portraying dangerous stunts;
- content portraying over consumption of food and/or beverages;
- content portraying weapons of any kind including, but not limited to, guns, bombs, or knives;
- content portraying material that promotes bigotry, racism, hatred or harm against any group or individual or promotes discrimination based on race, sex, religion, nationality, disability, sexual orientation, age or any basis protected by federal, state, or local law, ordinance, or regulation;
- content that denigrates, disparages or reflects negatively on the Sponsor, or its products or its employees, or any other person, company, product or service or that disparages Sponsor's competitors;
- audio and/or visual content owned by any third party (e.g., recorded music, pre-produced video, etc.); and
- material that is unlawful, in violation of or contrary to the laws or regulations in any state where the Video Submission is created.
If an entry includes any of the prohibited elements listed above, the Entry will be disqualified, along with the Participant who submitted it. Submission of an Entry grants Sponsor and its agents an unlimited, worldwide, perpetual license and right to publish, use, edit, adapt, modify and/or publicly perform the Entry in any way, in commerce and in any and all media worldwide now known or hereinafter developed, without limitation and without notice or consideration to the entrant. By submitting an entry, each Participant's parent or legal guardian further agrees that his/her entry constitutes an assignment of all rights, including but not limited to intellectual property rights, and title in and to such entry and the video therein to Sponsor. Sponsor may require Participant's parents or legal guardians to execute documents to confirm this transfer of rights. Failure to do so may result in disqualification. ENTRIES POSTED TO THE WEBSITE WERE NOT EDITED BY THE SPONSOR AND REPRESENT THE VIEWS/OPINIONS OF THE INDIVIDUAL PARTICIPANTS. Sponsor shall have the right, but not the obligation, to disclose any Video Submission to other persons and organizations, including without limitation, legal authorities.
- Judging of Entries: A panel of qualified judges chosen by the Sponsor will select ten potential winning Entries (the "Potential Winning Entries") from among all eligible Entries received using the following judging criteria: (i) Creativity of the Entry - 30%; (ii) Originality of the Entry - 30% and (iii) How the Entry addresses the topic of how whole grains can fuel lunchtime fun - 40%. The score each Potential Winning Entry receives, as determined by the judges, will represent 90% of a Potential Winning Entry's combined score that will be utilized in determining the Grand Prize Winner. Public Voting will comprise the remaining 10% of a Potential Winning Entry's score for purposes of determining the Grand Prize winner (see Rule 4, below). In the event of a tied score among the Entries, the Entries involved in the tie will be reviewed by an additional qualified judge who will serve as a tiebreaker, evaluating Entries according to criteria listed above and selecting the Potential Winning Entries on the basis thereof. The Potential Winning Entries will be determined on or about November 8, 2008. Decisions of judges are final and binding on all matters relating to judging of the Entries. The Potential Winning Entries will be selected by the judges under the supervision of O'Malley Hansen Communications, the Contest Judging Administrator ("Judging Administrator"). Potential Winning Entries are subject to validation and verification of eligibility and compliance with all terms and conditions set forth in these Official Rules.
- Public Voting: Beginning on November 8, 2008 at approximately 12:00 p.m. ET and ending on November 21, 2008 at 11:59:59 p.m. ET (the "Voting Period"), visitors to the Web Site may vote for individual Entries of their choice, from amongst the Potential Winning Entries selected by the judges as described in Rule 3 above. During the Voting Period, visitors may Vote for a Potential Winning Entry by following the onscreen voting instructions; upon successful completion of such, the Potential Winning Entry will receive one vote ("Vote"). At the end of the Voting Period each of the Potential Winning Entries will receive a score ranging from 10 thru 1 as determined by the rank in terms of total Votes received by each of the Potential Winning Entries (10 being the highest number of Votes received and 1 being the lowest number of Votes received). The score as determined by the Public Voting will represent 10% of the total score that will be utilized in determining the Grand Prize winner. Limit of one (1) vote per Potential Winning Entry per person during the entire Voting Period. Multiple votes for the same Potential Winning Entry by the same person may void all votes made by that person/email address at the Sponsor's sole discretion. Votes that do not comply with the Official Rules or any posted requirements, or that result from fraud or collusion, may be disqualified at the Sponsor's sole discretion. If a Participant is found to have engaged in such fraud or collusion, his/her Potential Winning Entry and any votes s/he received for such Potential Winning Entry will be disqualified.
- Potential Grand Prize Winner: Of the Potential Winning Entries, the Entry that receives the highest combined score will become the potential Grand Prize Winning Entry ("Potential Grand Prize Winner") of the Contest. The combined score will be determined by adding (i) the score as determined by the judges (representing 90% of the combined score) to (ii) the score as determined by Public Voting (representing 10% of the combined score). In the event of a tie, the Potential Winning Entries involved in the tie will be reviewed by an additional qualified judge who will serve as a tiebreaker, evaluating such Potential Winning Entries according to the criteria listed in Rules 3 and 4 above and selecting the Potential Grand Prize winner on the basis thereof.
- Winner Notification: On or about November 30, 2008, the Sponsor will notify the parent or legal guardian of Participant who submitted the Potential Grand Prize Winner by email, telephone and/or postal mail. The parent or legal guardian of such Participant will be required to submit Participant's valid social security number (for tax purposes only) and/or other requested identification to Sponsor, sign and properly execute, an assignment of rights in and to the Video Submission, an affidavit of eligibility, liability waiver, and where legal, consent to publicity about said Participant regarding the Potential Grand Prize Winner, and provide evidence of Third Party Participant assignments and releases (in the language and format provided via e-mail by Sponsor) and return all required documents within five (5) days of first written notification or the Potential Grand Prize Winner and the corresponding Participant may be disqualified and the prize may be awarded to the Participant who submitted next highest scoring Potential Winning Entry based on the combined score received per Rule 5, above.
In addition, the school at which the Participant who submitted the Potential Grand Prize Winner was enrolled at the time the Participant entered the Contest MUST agree to accept the $25,000 grant and the screening of the winning Sara Lee Soft & Smooth Lunchtime is Showtime Video with a visit from Corbin Bleu and Justin Martin to occur at the school at a time as determined by the Sponsor in order for the Grand Prize to be awarded to the Participant who submitted the selected potential Grand Prize Winner. An authorized administrator from the school associated with the Potential Grand Prize Winner will be required on behalf of the school to sign and properly execute, a liability release, appropriate event agreement and, consent to publicity, and return it within ten (10) days of first written notification
If the prize is not claimed in accordance with these Official Rules, or if any prize notification or documentation is returned as undeliverable, or if the parent or legal guardian of the Participant who submitted the Potential Grand Prize Winner or the school associated with the Potential Grand Prize Winner fails to properly execute and return all required documents described herein, and/or fails to schedule the celebrity visit as set forth in Section 5, below, the Grand Prize will be forfeited and awarded to the Participant whose Potential Winning Entry received the next-highest score in the final judging process described in Rule 5, above. Sponsor reserves all rights, including the right to edit, publish, use, adapt, or modify any Entries, including but not limited to names, likenesses, and photographs and text, for advertising and promotional purposes in all media (including and without limitation, the Internet) worldwide without limitation, approval or additional notice or compensation except where prohibited by law. If a Participant changes his/her telephone number, email address and/or street address after he/she enters the Contest, it is his/her or his/her parent's or legal guardian's responsibility to notify the Sponsor by postal mailing notice to: Interactive Engagement, Address Change, P.O. Box 1048, Duluth, GA 30096. Such notice must be received by the end of the Contest Period. Sponsor will use reasonable efforts to update Entrant contact information. Sponsor shall not be liable for any failure to notify the parent/legal guardian of the Participant whose Entry was selected as the Potential Grand Prize Winner in the total judging process if such Participant or his/her parent or legal guardian does not update Participant's contact information, or for the Administrator's failure to update such information.
- Grand Prize: One (1) Grand Prize will be awarded in part (as described below) to the Participant who submitted the Grand Prize Winning Entry and in part (as described below) to the school that the Participant attended at the time s/he submitted the winning Entry ("Grand Prize"). The Grand Prize will consist of a visit from Corbin Bleu and Justin Martin to the Participant's school for a screening of the winning Sara Lee Soft & Smooth Lunchtime is Showtime Video, a $25,000 grant to the Participant's school as noted above and one (1) year supply of free Sara Lee Soft and Smooth Bread for the winner (52 coupons for the purchase of 52 loaves). Total Approximate Retail Value of the Grand Prize: $25,145.08. Grand Prize celebrity visit must occur during a time period to be scheduled by Sponsor and agreed to by the authorized administrator of the school. No substitutions or transfers of Grand Prize permitted, in whole or in part, except at Sponsor's sole and exclusive discretion or as provided herein. Sponsor may substitute a different celebrity for the school appearance if a scheduled celebrity's schedule does not permit him to attend as originally planned.
- The following persons are NOT eligible to participate or win in the Contest: Employees, officers and directors of Sponsor, Judging Administrator, Administrator, The Walt Disney Company and each of their parent companies, affiliates, subsidiaries, related companies, suppliers, agents and retailers, advertising and promotion agencies, anyone involved in the creation, execution or fulfillment of this Contest, and members of the immediate families (defined as parents, siblings, children and spouse, and their respective spouses, regardless of where they reside) and/or households (whether related or not) of any of the above. Participation constitutes Participant's parent's/guardian's full and unconditional agreement to these Official Rules and the decisions of the Sponsor, Judges, Judging Administrator, and Administrator, which are final and binding in all matters related to the Contest. Participants or their parents/guardians not abiding by these Official Rules will be disqualified.
- General: Parents/guardians of Participants in the Contest assume all risk of loss, damage, destruction, delay or misdirection of materials/mail/email submitted to Sponsor or Administrator. Participant's parent or legal guardian agrees to the terms of and to be bound by these Official Rules and further agrees that the prize is awarded upon the condition that Sponsor, the Administrator The Walt Disney Company and each of their respective promotion/advertising agencies, printers, suppliers of Contest materials, their respective parent companies, affiliates and subsidiaries, and the officers, directors, partners, principals, partnerships, employees and agents of each of the foregoing shall have no liability whatsoever and shall be held harmless for any injuries, losses, or damages of any kind to persons or property, including death, sustained, in whole or in part, directly or indirectly, in connection with or resulting from acceptance, possession or use/misuse of the prize, or participation in this Contest or participation in any Contest-related or prize-related activities and further acknowledges that said parties have neither made, nor are in any manner responsible or liable for, any warranty, representation or guarantee, express or implied, in fact or in law, relative to the prize, including but not limited to its quality, mechanical condition or fitness for a particular purpose. ALL WARRANTIES (EXCLUDING THE BREAD PORTION OF THE PRIZE), INCLUDING THE IMPLIED WARRANTIES OF FITNESS AND MERCHANTABILITY ARE HEREBY DISCLAIMED. As a condition of entering, Participant's parent or legal guardian agrees that (1) under no circumstances will Participant and his/her parent/guardian be permitted to obtain awards for, and Participant and his/her parent/guardian hereby waives all rights to claim punitive, incidental, consequential or any other damages, other than for actual out-of-pocket expenses; (2) the Contest will be administered in Georgia and all causes of action arising out of or connected with this Contest, or the prize awarded, shall be resolved individually, without resort to any form of class action and shall be brought in a court of competent jurisdiction in the State of Georgia applying Georgia law; and (3) any and all claims, judgments and awards shall be limited to actual out-of-pocket costs incurred, including costs associated with entering the Contest, but in no event attorney's fees.
Sponsor, its parent company, subsidiaries, promotions agencies, printer, suppliers of promotional materials or any of their respective affiliates and the officers, directors, partners, principals, partnerships, employees and agents of each of the foregoing, are not responsible for typographical errors, security, technical, hardware, software or telephone failures of any kind, lost or unavailable network connections, fraud by any Entrant or voter, incomplete, garbled or delayed computer transmissions, or un-delivered, late, or illegible mail/email whether caused by Sponsor, Administrator, Participant or by any of the equipment or programming associated with or utilized in the Contest or by technical or human error which may occur and/or which may damage a user's system or limit a Participant's ability to participate in the Contest and/or receive the prize in the Contest or any virus, bugs, non-authorized human intervention or other causes that may corrupt or impair the administration, prize claim, security, fairness or proper play of the Contest (including but not limited to attempts to hack into or otherwise tamper with underlying source code/programming of the Contest). By accepting prize, winner's parent/guardian agrees that Sponsor may use winner's name, likeness, photograph and/or limited biographical information, without limitation, for promotional purposes without further consideration or payment, except where prohibited by law.
Sponsor reserves the right, in its sole discretion, to cancel, terminate, modify, or suspend this Contest should (in the Sponsor's opinion) human error, virus, bugs, non-authorized human intervention, fraud, or any other causes corrupt or affect the administration, security, fairness, publicity, or proper conduct of the Contest. In such case, Judges will select the Grand Prize Winner from all eligible Entries received prior to and/or after (if appropriate) the action taken by Sponsor based on the initial judging criteria stated herein. Sponsor reserves the right, at its sole discretion, to disqualify any individual it finds (in the Sponsor's opinion), to be tampering with the entry process or the operation of the Contest or Web Site. Sponsor may prohibit a Participant from participating in the Contest or winning the prize if, it determines (in the Sponsor's opinion) that said Participant is attempting or has attempted to undermine the legitimate operation of the Contest by cheating, hacking, deception, or other unfair playing practices or intending to annoy, abuse, threaten or harass any other persons or entities, including without limitation, Sponsor, any other entrants or Sponsor representatives.
